1. Contractual Relationship
1.1 The Agreement
These Terms and Conditions govern the purchase of blood testing kits and diagnostic laboratory services ("Services") from ARC. These Services are provided for diagnostic biomarker testing only.
1.2 Acceptance
By placing an order, you confirm that you have read, understood, and agreed to these Terms. Use of our website and services constitutes acceptance of this agreement.
1.3 Regulated Healthcare Standards
ARC operates as a regulated healthcare provider. These Terms are designed to meet clinical safety, transparency, and governance standards required for regulated health services in the United Kingdom.
1.4 No Guarantee of Treatment
Purchasing a test or consultation does not guarantee eligibility for treatment. Any prescription or treatment is subject to clinical review and a separate patient agreement.
2. Eligibility and Verification
2.1 Age and Residency
You must be 18 years of age or older and a resident of the United Kingdom to use our Services.
2.2 Identity Verification
As a regulated healthcare provider, we may require identity verification before providing services. We may use third-party identity verification tools to confirm your identity against public records. Failure to provide identification when requested may result in cancellation of services.
2.3 Accuracy of Information
You agree to provide accurate and complete personal and medical information. Providing false or misleading information may result in cancellation of services and may impact clinical safety.
3. Diagnostic Services
3.1 Nature of Services
Purchase of a blood test is a diagnostic step only. It does not establish a patient-clinician relationship and does not guarantee treatment or prescription. Treatment decisions are made following clinical review.
3.2 Kit Expiry
Testing kits must be used and returned within 6 months of purchase. Kits not used within this period become void and non-refundable.
3.3 Laboratory Analysis
ARC uses third-party UKAS-accredited laboratories for analysis. These laboratories are responsible for the analytical accuracy of your sample.
3.4 Failed Samples
If a sample fails due to haemolysis, insufficient volume, or processing issues:
- One replacement kit will be provided free of charge
- A second failure may incur a £15 administrative fee
- Venous sampling may be recommended after repeated failures
3.5 Professional Use Kits
Venous draw kits are intended for use by qualified professionals only. ARC accepts no liability for samples taken by unqualified individuals.
4. Clinical Safety and Results
4.1 Critical Results
If results indicate values requiring urgent medical attention, you consent to ARC or its clinical partners contacting you using the contact details provided.
4.2 Not an Emergency Service
ARC does not provide emergency medical care. If you experience acute symptoms, you should contact NHS 111 or dial 999 immediately.
4.3 Responsibility for Follow-Up
You are responsible for reviewing your results and seeking further medical advice where appropriate.
5. Appointments and Phlebotomy Services
5.1 Appointment Availability
Clinic and home visit appointments are subject to availability and may be rescheduled if necessary.
5.2 Cancellations
Appointments cancelled with less than 24 hours notice may be non-refundable.
5.3 Non-Attendance
Failure to attend a booked appointment may result in loss of the appointment fee.
6. Cancellations and Refunds
6.1 Before Dispatch
Orders cancelled before dispatch are eligible for a full refund.
6.2 After Dispatch (Unopened)
You may cancel within 14 days of delivery if the kit remains unopened. A £15 fee may be deducted to cover shipping, handling, and kit costs.
6.3 After Sample Submission
Once your sample has been received by the laboratory, no refunds can be issued.
6.4 Used Kits
Testing kits are single-use medical devices and cannot be returned once opened.
6.5 Phlebotomy Services
Cancellations with less than 24 hours notice or missed appointments are non-refundable.
7. Delivery
7.1 Shipping
Delivery timeframes are estimates and not guaranteed.
7.2 Lost or Delayed Shipments
ARC is not responsible for courier delays outside our control. Replacement kits may be issued at our discretion.
7.3 Incorrect Address
Customers are responsible for providing accurate delivery details.
8. Data and Clinical Records
8.1 Clinical Management System
ARC uses secure clinical systems to manage patient records. Your information is stored in line with healthcare data protection requirements.
8.2 Record Retention
We are legally required to retain clinical records for a defined period. Requests for deletion may be limited where data must be retained for legal or regulatory purposes.
9. Limitation of Liability
9.1 Diagnostic Information Only
Results are provided for informational and diagnostic purposes only and should not replace independent medical advice.
9.2 Sample Collection
ARC is not responsible for inaccurate results caused by incorrect sample collection outside our control.
9.3 Third Party Providers
ARC is not liable for delays or errors caused by third-party laboratories or courier services.
10. Changes to Services
We reserve the right to modify or discontinue services, pricing, or testing panels where necessary for clinical or operational reasons.
11. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
